1. Definitions
In these Terms and Conditions:
- "Dragonwell" refers to the residential home operated at 52 Tin Hau Temple Road, North Point, Hong Kong.
- "Services" refers to the residential arrangements, programmes, and stays offered by Dragonwell.
- "Resident" refers to a person who lives in the home under a residential arrangement.
- "Family" or "Representative" refers to the family member or appointed person managing the arrangement on behalf of a resident.
- "You" refers to any person accessing the Dragonwell website or enquiring about services.
- "Agreement" refers to the binding agreement entered into when a placement is confirmed.
2. Acceptance of Terms
By using our website or submitting an enquiry, you agree to these Terms and Conditions. Placement of a resident at Dragonwell constitutes a formal Agreement between Dragonwell and the family representative, subject to a separate written placement agreement.
Our services are available to individuals aged 18 and over. Enquiries relating to older adults must be made by a person with legal authority to act on their behalf where appropriate.
3. Description of Services
Dragonwell offers the following arrangements:
- Terrace Residence — Full-time residential living at HK$13,300 per month
- Storytelling & Memory Circle — Twice-weekly group programme at HK$1,500 per month
- Weekend Respite Arrangement — Friday–Sunday stay at HK$1,900 per weekend
Services are subject to availability. Dragonwell reserves the right to decline a placement if it determines that the home is not the appropriate setting for a particular individual's needs.
4. User Responsibilities
When using our website or entering into a service arrangement, you agree to:
- Provide accurate and complete information when submitting enquiries or entering into an arrangement
- Inform Dragonwell of any relevant changes to a resident's health or personal circumstances in a timely manner
- Communicate respectfully with staff and other residents
- Comply with the visiting hours and internal guidelines of the home
- Not use the website for any unlawful purpose
5. Payment Terms
Fees are payable in Hong Kong Dollars (HKD). For residential arrangements, payment is due monthly in advance. For the Storytelling Circle, payment is monthly. For the Weekend Respite Arrangement, payment is due before or on the date of arrival.
Accepted payment methods will be confirmed at the time of arrangement. Late payment may result in suspension of services after reasonable notice.
Cancellation and Refunds: For residential placements, one month's written notice is required to end the arrangement. Weekend respite bookings cancelled with fewer than five days' notice may be subject to a partial charge. Refund terms for individual circumstances will be discussed directly with the family.
6. Service-Specific Terms
Terrace Residence
- Placement is subject to assessment of suitability and available space
- The monthly fee covers accommodation, meals, housekeeping, laundry, and activities as described
- Medical care is not included and remains the responsibility of the resident and family
Storytelling & Memory Circle
- Sessions run Tuesday and Thursday, 10 AM–noon, subject to schedule changes with reasonable notice
- Story recordings are made available to families only with the participant's consent
Weekend Respite Arrangement
- Advance booking of at least one week is required
- Medical emergencies during a stay will be handled by directing the guest to appropriate emergency services
7. Intellectual Property
All content on the Dragonwell website — including text, images, and design — is the property of Dragonwell and may not be reproduced without written permission. Users are granted a limited licence to access the website for personal, non-commercial purposes.
8. Disclaimers
Dragonwell is a non-medical residential home. Nothing in our website, materials, or services constitutes medical advice. Families are responsible for coordinating any medical care their relative requires.
The website is provided "as is" without warranties of any kind. We make reasonable efforts to keep content current and accurate but cannot accept liability for any inaccuracies.
9. Limitation of Liability
To the extent permitted by Hong Kong law, Dragonwell's liability for any claim arising from the use of our website or services shall not exceed the fees paid in the month in which the relevant issue occurred. We shall not be liable for indirect, consequential, or incidental losses arising from the use of our services.
10. Indemnification
You agree to indemnify Dragonwell against any claims, losses, or expenses arising from your use of the website in breach of these Terms, or from any misrepresentation made in connection with a service enquiry or arrangement.
11. Termination
Either party may end a residential arrangement with one month's written notice. Dragonwell may terminate an arrangement with shorter notice in exceptional circumstances where the safety or wellbeing of residents or staff is at risk, following reasonable process.
On termination, fees owed up to the date of departure remain payable. Any overpaid fees will be refunded within 14 days.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of Hong Kong Special Administrative Region. In the event of a dispute, the parties agree to attempt resolution through direct communication in the first instance. If unresolved, disputes shall be subject to the jurisdiction of the courts of Hong Kong SAR.
Mediation may be offered as an alternative to litigation where both parties agree.
13. General Provisions
- Entire Agreement: These Terms, together with any written placement agreement, constitute the full agreement between the parties.
- Severability: If any provision is found unenforceable, the remaining terms continue in effect.
- Waiver: Failure to enforce any provision on one occasion does not waive that right in future.
- Notices: Formal notices may be sent by email or post to the addresses provided at the time of arrangement.
14. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised date. Continued use of our website or services after changes constitutes acceptance of the revised Terms. For active arrangements, we will provide reasonable notice of material changes.
